These terms cover your membership of The Boat Club of Texas and your use of our website and app. Using either means you accept them.
Membership
Membership is personal to you and cannot be transferred or shared. You must be at least eighteen. Boats may only be operated by a member the club has certified for that boat, and every operator must hold any licence or boater education card Texas law requires.
Reservations
- Reservations are made through the app and are first come, first served.
- Arrive on time. Late arrival does not extend your reservation, and the boat may be released if you do not appear.
- Cancel as early as you can so another member can take the slot. Repeated no-shows may cost you booking privileges.
- The club may cancel a reservation for weather, mechanical trouble or safety. We will tell you as soon as we can and you will not be charged for a reservation the club cancels.
Your responsibility for the boat
You are responsible for the boat while it is in your care. Complete the dock check-out and check-in with the staff, including the photographs, before you leave and when you return.
You are responsible for loss or damage caused by your use, by anyone you bring aboard, or by operating outside these terms — including damage from negligence, operating under the influence, or ignoring posted limits and instructions from staff. Fuel, and any fees or fines you incur, are yours to pay.
Safety
Follow all federal, state and local boating law, and follow the instructions of club staff. Life jackets and required safety equipment must be aboard and used as the law requires. The club may end a reservation immediately and suspend membership for unsafe operation.
Dues and payment
- Dues are billed in advance on a recurring basis to the payment method you keep on file, and you authorise us to charge it until you cancel.
- Charges other than dues — fuel, damage, fees — are billed to the same method.
- If a payment fails we may suspend your access to reservations until the balance is cleared.
- Dues already paid are not refundable except where the law requires it.
Cancelling your membership
Tell us and we will cancel. Cancellation takes effect at the end of the period you have already paid for. The club may end a membership for non-payment, unsafe operation or repeated breach of these terms.
The website and the app
The website and app are provided as they are. We work to keep them running but we do not guarantee they will be available without interruption, and an outage does not by itself entitle you to a refund of dues. Reservations confirmed in the app are subject to boat availability and the club's records.
Limits
To the fullest extent Texas law allows, the club's liability arising from your membership is limited to the dues you paid in the twelve months before the claim. Nothing here limits liability that cannot be limited by law.
Governing law
These terms are governed by the laws of the State of Texas, and disputes belong to the courts of Harris County, Texas.
Changes
We may update these terms. We will change the date at the top and, for anything significant, tell members directly.
